Overview

The website www.vita-asana.com is operated by VITA ASANA SRL under the store name Vita Asana.

Throughout these Terms of Service, “Vita Asana,” “we,” “us,” and “our” refer to VITA ASANA SRL.

These Terms govern your access to and use of our website, online store, products, customer-account features, content, customer support, and related services.

Our store is hosted by Shopify, which provides the ecommerce platform used to operate the website and process transactions. Shopify is not the seller of products purchased directly from Vita Asana. Your purchase contract is with VITA ASANA SRL.

Nothing in these Terms excludes, restricts, or limits any consumer right, product-safety obligation, warranty, remedy, or liability that cannot lawfully be excluded, restricted, or limited.

This facility is not our registered office, a retail store, or a walk-in customer service location. Products must not be returned there without prior written authorization and return instructions.

We may use authorized domestic and international fulfillment partners to store, prepare, and dispatch orders. VITA ASANA SRL remains responsible for your purchase, customer support, returns, and refunds regardless of which authorized partner fulfills the order.

The use of a U.S. fulfillment facility does not, by itself, mean that a product was manufactured in the United States.

Vita Asana currently accepts orders only for eligible United States delivery addresses shown as available during checkout.

2. Eligibility and Customer Accounts

By using our services, you confirm that:

  • You are at least the age of majority in your state of residence.

  • You have the legal capacity to enter into a binding agreement.

  • You will use our services only for lawful purposes.

  • The information you provide is accurate, complete, and current.

  • You are authorized to use any payment method submitted with an order.

  • You are not placing an order on behalf of another person without appropriate authorization.

Our services are intended for adults and are not directed to children under 13 years of age.

If you create a customer account, you are responsible for maintaining the confidentiality of your login credentials and notifying us promptly about suspected unauthorized access or activity.

We may use reasonable verification measures before changing account information, discussing an order, processing a refund, or taking other security-sensitive action.

3. Product Information and Availability

We take reasonable steps to present product descriptions, photographs, specifications, dimensions, materials, colors, functions, package contents, compatibility information, and safety information accurately.

However:

  • Colors may vary slightly because of lighting, photography, production batches, and display settings.

  • Dimensions and measurements may be subject to reasonable manufacturing tolerances.

  • Props or accessories shown in lifestyle images are not included unless expressly listed.

  • Packaging may change without materially changing the product.

  • Availability can change before an order is accepted.

  • Product features, included components, and instructions may vary between models or variants.

The product information presented when you place your order applies to that purchase. If we identify a material error affecting an order, we will contact you with the corrected information and provide any cancellation or refund option required by applicable law.

We may discontinue products, limit quantities, or restrict purchases where reasonably necessary for inventory management, safety, fraud prevention, or compliance purposes.

4. General Wellness and Medical Information

Unless expressly and lawfully stated otherwise for a particular product, Vita Asana products are offered for general wellness, comfort, fitness, relaxation, mobility, personal care, or home use.

Our products, website content, product descriptions, customer support, and other general information are not intended to provide:

  • Medical advice

  • Diagnosis

  • Treatment recommendations

  • Rehabilitation guidance

  • Emergency assistance

  • A prescription

  • A substitute for professional healthcare

Unless a product is expressly identified and lawfully marketed as such, we do not represent it as a medical device or as being intended to diagnose, treat, cure, mitigate, or prevent any disease or medical condition.

References to comfort, relaxation, massage, heat, light, stimulation, recovery, posture, mobility, fitness, or general wellness do not guarantee a medical or clinical result. Individual experiences may vary.

Consult an appropriately qualified healthcare professional before using a product if you:

  • Have an existing medical condition, injury, or unexplained symptoms

  • Are pregnant or may be pregnant

  • Recently underwent surgery

5. Product Safety and Proper Use

Before using a product, review and follow all supplied instructions, warnings, labels, limitations, cleaning directions, and safety precautions.

Where applicable, you are responsible for:

  • Inspecting the product before use

  • Using it only for its intended purpose

  • Following applicable time, temperature, weight, age, and capacity limits

  • Using the product on an appropriate, dry, stable surface

  • Using compatible power supplies and accessories

  • Providing appropriate adult supervision

  • Keeping the product away from water, heat, children, or pets where instructed

  • Performing reasonable cleaning and maintenance

Do not modify a product, bypass a safety feature, or continue using a product that appears damaged, unstable, unusually hot, electrically unsafe, or otherwise abnormal.

Stop using the product if it causes pain, excessive heat, numbness, dizziness, skin irritation, or other unexpected discomfort.

Improper use, unauthorized modification, accidental damage, or failure to follow supplied instructions may affect a voluntary product-specific warranty where permitted by law. This does not remove any non-waivable right relating to a defective or unsafe product.

6. Orders and Contract Formation

Products placed in a shopping cart are not reserved.

Submitting an order constitutes an offer to purchase the selected products at the price and under the conditions displayed during checkout.

An automated order confirmation acknowledges that we received your order. It does not necessarily mean that the order has been accepted.

Unless applicable law provides otherwise, an order is accepted when we send a dispatch confirmation or otherwise expressly confirm acceptance.

Before acceptance, we may decline, limit, or cancel an order for reasons including:

  • Product unavailability

  • An obvious pricing or product-information error

  • An incomplete or undeliverable address

  • A delivery address outside our supported U.S. market

  • Payment authorization failure

  • Reasonable evidence of fraud, unauthorized payment, or policy abuse

  • Purchasing limits or suspected unauthorized resale

  • Legal, regulatory, or product-safety requirements

If we cancel an order after collecting payment, we will promptly initiate a full refund for the cancelled amount to the original payment method.

Products are intended primarily for personal or household use. Purchasing for unauthorized commercial resale is prohibited without our prior written permission.

7. Prices, Taxes, and Promotions

Unless expressly stated otherwise, all prices are displayed and charged in United States dollars.

The applicable product price is the price shown in your order summary when the order is submitted, subject to correction of an obvious error.

Applicable discounts, shipping charges, taxes, and other required charges will be displayed before you submit the order where required.

Prices and promotions may change before an order is placed. We will not increase the price of an accepted order without your agreement, except where a correction or charge is required by law.

If an obvious typographical, technical, or pricing error affects an order, we may contact you with the corrected information before fulfillment. If you do not accept the correction, or if the order cannot lawfully be fulfilled as displayed, we may cancel the affected item and refund any amount already collected.

Promotions and discount codes may:

  • Apply only to eligible products

  • Have stated start and end dates

  • Require a minimum purchase

  • Be limited by customer, account, address, or household

  • Be limited to one use

  • Exclude shipping or optional services

  • Be unavailable in combination with another offer

Unless expressly stated otherwise, promotions have no cash value and cannot be applied retroactively after an order has been submitted.

8. Payments

Available payment methods are displayed during checkout and currently may include:

  • Visa

  • Mastercard

  • PayPal

  • Google Pay

  • Apple Pay

Payment-method availability may depend on the device, browser, order, and payment provider.

By submitting payment information, you confirm that:

  • You are the authorized payment-method holder or have the holder’s permission.

  • Your billing and payment information is accurate.

  • You authorize us and our payment providers to charge the total displayed during checkout.

  • You authorize reasonable transaction, address, authentication, and fraud-prevention checks.

A pending authorization is not necessarily a completed charge. Your financial institution or payment provider may control authorization holds, processing times, currency-conversion charges, and other independently imposed fees.

9. Shipping and Fulfillment

Vita Asana currently ships only to eligible United States addresses shown as available during checkout.

Orders may be fulfilled through our U.S. facility or through authorized domestic or international fulfillment partners. The shipping origin shown in tracking may therefore vary by product and order.

Orders containing multiple products may arrive in separate packages or on different dates.

Processing and delivery estimates are provided in our Shipping Policy. Delivery estimates are not guarantees, but we will meet all shipping, delay-notification, cancellation, and refund obligations required by applicable law.

If we learn that an order cannot be shipped within the timeframe represented when it was placed, we will provide the delay, consent, cancellation, or refund options required by law.

You are responsible for providing a complete and accurate delivery address. Contact us immediately if an address needs to be corrected. Address changes cannot be guaranteed after processing or fulfillment has started.

10. Cancellations, Returns, and Refunds

Contact us as soon as possible if you want to cancel an order. Cancellation requests are not guaranteed once processing, label creation, or fulfillment has begun. A cancellation is effective only when confirmed by Vita Asana.

Refusing delivery does not automatically constitute an authorized cancellation or return.

Eligible products may be returned within 30 calendar days after carrier-confirmed delivery, subject to the eligibility conditions, exclusions, authorization process, and instructions in our Return and Refund Policy.

Do not mail a product back before receiving written authorization and the correct return instructions.

Inspect your order promptly after delivery. Contact us as soon as reasonably possible if a product arrives damaged, appears defective, is materially different from what was ordered, or is missing a confirmed component.

Change-of-mind return conditions do not remove any non-waivable remedy applicable to a defective, unsafe, incorrect, or materially misdescribed product.

11. Product-Specific Warranties

Vita Asana does not provide a single blanket commercial warranty covering every product.

A voluntary written warranty applies only when it is expressly identified for the particular product and made available before purchase. Any such warranty will state its duration, coverage, exclusions, warrantor, and claim process.

A manufacturer’s warranty may apply separately where expressly provided with the product.

Nothing in these Terms excludes or limits any implied warranty, statutory guarantee, consumer remedy, or other right that cannot lawfully be excluded or limited.

12. Reviews, Feedback, and Customer Content

Customer reviews displayed by Vita Asana are submitted in connection with customer orders. A “verified purchase” or similar label will be used only where the review can be matched to an order.

If you submit a review, photograph, video, comment, question, or other content, you confirm that:

  • The content reflects your genuine experience.

  • You created it or have permission to submit it.

  • It is accurate to the best of your knowledge.

  • It does not infringe another person’s intellectual-property, privacy, or publicity rights.

  • It does not contain private information, malware, unlawful material, or unauthorized advertising.

You retain ownership of your content. You grant Vita Asana a non-exclusive, worldwide, royalty-free license to host, reproduce, format, display, and use it in connection with our store, customer support, product information, and marketing for as long as reasonably necessary, subject to applicable law.

We may decline or remove content that is spam, unrelated, clearly false or misleading, unlawful, abusive, discriminatory, obscene, infringing, or privacy-invasive.

We do not suppress a genuine review solely because it is negative or critical.

Any incentive offered for a review will not be conditioned on positive sentiment and will be disclosed where required.

Reviews describe individual experiences. They do not guarantee that another customer will obtain the same result and do not independently establish a medical or performance claim.

13. Intellectual Property

The website and its content—including the Vita Asana name, logo, branding, design, text, graphics, photographs, videos, product descriptions, and software—are owned by or licensed to VITA ASANA SRL and are protected by applicable intellectual-property laws.

We grant you a limited, non-exclusive, revocable right to access and use the website for lawful personal shopping and informational purposes.

Without prior written permission, you must not reproduce, distribute, republish, sell, license, scrape, commercially exploit, or create derivative works from protected website content, except where applicable law permits.

Purchasing a physical product does not transfer ownership of Vita Asana’s branding, website content, photography, or other intellectual property.

14. Third-Party Services and Links

Our services may include third-party payment methods, applications, analytics tools, review systems, tracking services, social-media features, customer-support tools, and external links.

Independent third-party services may be governed by their own terms, privacy practices, and security measures.

We are not responsible for independently controlled third-party websites or services to the extent permitted by law. However, the use of a fulfillment, technology, or payment provider does not remove VITA ASANA SRL’s responsibilities as the seller of products purchased directly through Vita Asana.

15. Privacy and Electronic Communications

Our collection and use of personal information are described in our Privacy Policy and Cookie Policy.

By placing an order or contacting us, you agree to receive necessary transactional communications relating to your order, payment, delivery, return, refund, account, security, or customer-support request.

Agreeing to these Terms does not, by itself, constitute consent to receive optional marketing communications. You may unsubscribe from marketing messages using the method provided in those messages.

16. Prohibited Uses

You must not use our services to:

  • Violate any applicable law or regulation

  • Commit or facilitate fraud

  • Use a payment method without authorization

  • Submit false, misleading, or impersonated information

  • Abuse promotions, returns, refunds, reviews, store credit, or payment disputes

  • Upload malware or harmful code

  • Attempt unauthorized access to a system or account

  • Interfere with website security or operation

  • Harvest personal information without authorization

  • Infringe intellectual-property, privacy, or other legal rights

  • Harass, threaten, abuse, or discriminate against another person

Nothing in this section restricts an honest review, lawful consumer complaint, legitimate payment dispute, report to a regulator, or exercise of a legal right.

We do not guarantee that the website will always be uninterrupted or error-free.

Information may occasionally contain errors relating to descriptions, specifications, prices, promotions, availability, shipping charges, or delivery estimates. We may correct identified errors.

If a material correction affects an order already submitted, we will contact you, request confirmation where appropriate, cancel the affected item if necessary, and issue any applicable refund.

18. Disclaimers and Limitation of Liability

To the fullest extent permitted by applicable law, the website and its general informational content are provided on an “as available” basis.

This does not mean that physical products are sold “as is,” and it does not exclude any product warranty, statutory guarantee, safety obligation, or consumer remedy that cannot lawfully be excluded.

We do not guarantee:

  • Uninterrupted access to the website

  • Compatibility with every device or software configuration

  • A particular wellness, comfort, fitness, or personal result

  • That every website error will be corrected immediately

To the fullest extent permitted by applicable law, Vita Asana will not be liable for indirect, incidental, special, or consequential losses that were not reasonably foreseeable.

For claims that may lawfully be limited, our total liability will not exceed the amount paid for the affected product or order giving rise to the claim.

These limitations do not apply to fraud, willful misconduct, gross negligence where applicable, death or personal injury caused by negligence, defective-product liability, privacy obligations, or any liability or consumer right that cannot lawfully be excluded or limited.

Some jurisdictions do not permit certain exclusions or limitations. In those jurisdictions, the relevant limitation applies only to the maximum extent permitted by law.

19. Payment Disputes and Fraud Prevention

We encourage you to contact us about an order, delivery, product, return, or refund concern before opening a payment dispute so that we have an opportunity to investigate and assist.

This does not prevent you from exercising a legitimate right through your bank, card issuer, PayPal, payment provider, regulator, consumer-protection authority, or court.

Where a payment dispute is opened, we may provide the payment provider with information reasonably relevant to the transaction, consistent with our Privacy Policy.

While the same funds are subject to an active chargeback, reversal, or payment hold, we may pause a separate refund solely to avoid duplicate reimbursement. You are not entitled to recover the same amount twice.

We may take proportionate action where there is credible evidence of unauthorized payment, deliberate misrepresentation, fraud, or abuse. We will not treat a genuine complaint or legitimate payment dispute as fraud merely because we disagree with it.

20. Suspension, Termination, and Events Outside Our Control

We may restrict or terminate access to an account or service where reasonably necessary to address fraud, security threats, unlawful activity, repeated policy violations, or harm to customers or service providers.

Suspension or termination does not remove rights or obligations arising from an existing order, payment, return, refund, warranty, dispute, or applicable law.

We are not responsible for delay or failure caused by events outside our reasonable control, such as severe weather, natural disasters, government action, public emergencies, labor disruption, carrier interruption, cyberattacks, utility failure, or supply-chain disruption.

We will take reasonable steps to communicate material delays and reduce their effects. This provision does not eliminate any legally required shipping, cancellation, or refund right described in our Shipping Policy.

21. Governing Law and Dispute Resolution

Except where mandatory law requires otherwise, these Terms and contracts formed through Vita Asana are governed by the laws of Romania, without regard to conflict-of-law principles.

This choice of law does not deprive a United States consumer of any mandatory protection available under applicable federal or state law. It also does not require a claim to be brought in Romania where applicable law gives the consumer the right to use another lawful forum.

A dispute may be brought before any court that has jurisdiction under applicable law.

Before beginning formal proceedings, we encourage you to contact us through our Contact Us page so that we can review the matter and attempt to resolve it in good faith. Contacting us first is not a condition of exercising a non-waivable legal, regulatory, or payment-dispute right.

22. General Provisions and Changes

If any provision of these Terms is found unlawful, invalid, or unenforceable, it will be enforced to the maximum extent permitted or severed where necessary. The remaining provisions will continue in effect.

A failure or delay in enforcing a provision does not waive that provision or any other right.

You may not transfer an account or contractual obligation without our permission. We may transfer our rights or obligations as part of a legitimate business reorganization, merger, acquisition, or asset transfer, provided that this does not reduce your consumer rights.

If these Terms conflict with a product-specific condition or a subject-specific linked policy, the more specific term governs that subject, unless applicable law requires otherwise.

The version of these Terms in effect when an order is placed will generally govern that order.

We may update these Terms prospectively to reflect changes in our services, business practices, technology, or legal obligations. The updated version will display a revised “Last updated” date. Material changes will not be applied retroactively to an existing order unless required by law, agreed by you, or more favorable to you.
